NY state revokes approval of Charter-Time Warner Cable deal

NYS moves to kick Charter Communications out of state

The commission's approval of the merger in January 2016 was contingent on Charter bringing broadband service to 36,250 new addresses per year for four years. NY accepted the deal at the time on the contingency that the company meet several performance goals in the future. The company must provide uninterrupted service while the state transitions to a new service provider, the commission said. As a result, the New York State Public Service Commission revoked the approval of the merger.

Today in a move many didn't think would happen NY ordered Chater to leave the state.

"Charter's repeated failures to serve New Yorkers and honor its commitments are well documented and are only getting worse", PSC Chairman John Rhodes said in a statement. "Charter's non-compliance and disrespectful behavior toward New York State and its customers necessitates these actions, court-ordered penalties for its failures, and revoking the Charter merger approval".

"In the weeks leading up to an election, rhetoric often becomes politically charged", Charter said in a statement Friday.

The PSC accused Charter of repeatedly failing to meet deadlines, not filling its obligations to serve rural communities and "purposeful obfuscation of its performance". Although Spectrum says it made its network available to over 86,000 residents, NY was planning on 145,000 businesses and homes being serviced. In September 2017, PSC and Charter reached a settlement worth up to $13 million that revised the buildout schedule and imposed a $1 million penalty (drawn from the $13 million settlement) for each target Charter missed.

Charter's claims are simply false and the Commission will not stand idly by while Charter deceives the public and its shareholders. "During the transition process, Charter must continue to comply with all local franchises it holds in New York State and all obligations under the Public Service Law and the Commission regulations".

Assemblyman Anthony Brindisi, who is running for Congress this fall, has pushed for Charter/Spectrum to live up to the promises the company made when it took over Time Warner Cable.

7 News has reached out to Charter for comment. In a statement, the company said they have "extended the reach of [their] advanced broadband network to more than 86,000 NY homes and businesses".

Charter is the largest cable provider in the state.
