EU Withdrawal Bill debate: Day 1

MPs are set to stage an audacious power grab on Tuesday which could completely change the Government's Brexit strategy.

He said Mrs May promised to table amendments in the House of Lords based on his own proposal for Parliament to be consulted on the way forward if no deal is agreed by the end of November.

"This includes not only being in the single market, being in the customs union, accepting the ECJ judgments, accepting ongoing large payments of the EU, it'll include things like being in the European Arrest Warrant and the European Investigative Order".

Details of precisely what this will involve could emerge in the coming days when the EU Withdrawal bill is due to return to the House of Lords.

Supporters of this policy argue it would protect British jobs and go some way to preserving the invisible Irish border, while detractors point out it would prevent Britain from signing its own trade deals after it has left the EU.

It paid off. "I'm quite satisfied that we are going to get a meaningful vote on both "deal" and "no deal"," Grieve told Sky News.

But she told MPs that "the government's hand in negotiations can not be tied by parliament".

He said: "I understand the difficulties MPs representing constituencies which voted strongly for Leave or Remain have on the EEA amendment to the EU Withdrawal Bill".

There was little doubt the government would win on the customs union and single market, which some pro-EU lawmakers say is the only way for Britain to retain economically advantageous close ties with the bloc, with the opposition Labour Party also divided over future relations.

Mr Davis was in Brussels on Monday for the latest round of negotiations with Mr Barnier.

A compromise seems to have been reached, which will see the Government report back on talks around a customs arrangement with the European Union - a long standing aim.

In what was seen at Westminster as a boost for the Government, a potential defeat for Mrs May on the customs union seemed less likely as a compromise amendment was put together by Remain backers Sir Oliver Letwin and Nicky Morgan, as well as Brexiteers Jacob Rees-Mogg and Sir Bill Cash, which called for "a customs arrangement" with the EU.

The Lords amendment was defeated in the Commons Tuesday by 324 votes to 298. It contains the caveat that MPs can examine changes in smaller groups - meaning they won't be held up by scrutiny in the Commons chamber. In my view, this raises the important principle of legitimacy: I do not believe it would be right for the Government to pursue such a course without a plan to seek a confirmatory mandate for the outcome.

Tory former attorney general and leading pro-Europe rebel Dominic Grieve urged ministers to back his compromise amendment on the meaningful vote.

Passing the amendment would mean a major shift away from the UK's existing constitutional settlement - which gives the executive powers to negotiate treaties.

Citizens would be able to challenge any domestic laws introduced if it seriously went against the European Union laws copied over after Brexit.

In a few weeks, MPs will vote on another piece of Brexit-related legislation called the trade bill.

Theresa May would have to get approval from Parliament before beginning negotiations on the UK's future relationship with the EU. That supposedly, according to BBC's Political Editor Laura Kuenssberg, drew a colorful response from a pro-EU Tory rebel: "If she f**ks us, she's f**ked".

The Prime Minister's flagship legislation is on a knife edge as the government bids to reverse a slew of amendments imposed by the House of Lords. This was originally changed following pressure in the Commons from Brexit-backing MPs who wanted to ensure the date of departure was written into law.
