Facebook faces a class action lawsuit over claims that it used facial recognition tools on users' photos without their permission, a United States judge has ruled. But despite Facebook's success in getting the case moved from IL to San Francisco, the judge ruled that "plaintiffs' claims are sufficiently cohesive to allow for a fair and efficient resolution on a class basis".

Facebook violated an IL state law by improperly using their photo-scanning and facial recognition technologies and storing biometric data without their users' consent, a federal judge in California ruled on Monday, after reviewing a 2015 claim made against Facebook by three IL plaintiffs. The lawsuit was originally filed back in 2015 by users in IL, accusing the social network of violating a law in the state that prohibits the collection of biometric info.

The legal move on Monday comes as Facebook has come under scrutiny for how it handles users data, particularly after revelations that consulting firm Cambridge Analytica harvested up to 87 million people's information, many without consent. It's a hot-button issue, as sweeping new European Union privacy legislation requires Facebook and other tech companies to get explicit permission for using the technology.

Facebook, which tried to get the case thrown out, said it was reviewing the ruling. The social network turned off facial recognition in Europe in 2012, the website says.

Carolina Milanesi, the author of the study, found that when asked on how Facebook can regain user trust, rather than getting more tools and settings, a lot of the users are asking for the company's transparency.

A California judge on Monday gave the green light to a three-year-old case claiming the social network violated IL law.

The plaintiffs say Facebook's creation and storing of face templates for automatic photo-tagging purposes is prohibited under BIPA.

This template is then used to suggest tags for other images if it recognises the faces in them.
