FBI Found No Evidence That Border Patrol Agent Was Murdered

Rogelio Martinez

The incident happened last November.

Martinez, a native of El Paso, had been a border patrol agent since August 2013.

Garland, who was disoriented and unsure of his location on the day of the incident, told the Border Patrol dispatcher he and Martinez were hurt, the Federal Bureau of Investigation said.

A spokesman for the National Border Patrol Council, the union that represented the officers, said it was an "ambush".

He reported: "We ran into a culvert", "I ran into a culvert", or "I think I ran into a culvert", the dispatcher noted.

"The dispatcher also wrote into a Border Patrol log, "[He] thinks they (both agents) ran into a culvert". This fact matters because ever since Martinez was found with a fractured skull in a West Texas culvert, conservative lawmakers and media outlets have eagerly blamed undocumented immigrants for his death.

And President Donald Trump said the injured agent had been "brutally beaten" as he called again for the construction of a wall between the United States and Mexico.

Trump tweeted the next day that Martinez was "killed", adding "we will seek out and bring to justice those responsible. We will, and must, build the Wall!"

Arizona Rep. Martha McSally, now running for Arizona's open Senate seat called it a "murder" and said it should serve as a "wake up call to our country that we must have the resolve to secure our border and protect Americans from deadly threats like these".

Sen. Ted Cruz (R-Texas) also described both agents as having been "attacked" and suggested that it was the result of an "unsecure border". The reward for information has been raised to $50,000, and tips can be called into the El Paso office at 915-832-500.

El Paso - Today, FBI El Paso Special Agent in Charge Emmerson Buie is sharing findings to date of the investigation into the death of U.S. Border Patrol Agent Rogelio Martinez on November 19, 2017.

Rogelio Martinez died from injuries sustained in November a year ago while responding to reports of a late-night incident near Interstate 10 in remote west Texas, about 30 miles from the border with Mexico. Agent Martinez later succumbed to his injuries. "Our view is he was attacked", he told CNN, referring to the FBI's investigation.

In the wake of the mysterious incident, local cops suspected that Martinez and his partner might have been clipped by a tractor trailer as they stood just a few feet from the busy Interstate 10. He told the Dallas Morning News that investigators were looking at the possibility that the agents fell into the culvert in a nighttime accident. A total of 26 searches have been carried out in Texas and New Mexico. Martinez was on patrol in the Big Bend Sector when he died in the line of duty. They have found no evidence to support that. According to an autopsy report from the El Paso County Office of the Medical Examiner, the cause of Martinez's death is blunt force injuries of the head, but the manner of death is still undetermined.

But that part of the investigation only led to a smuggling of an illegal alien indictment. The defendants are innocent until proven guilty in a court of law.

The FBI and the state of Texas have offered a $70,000 reward for information in this case.
