Appeals court rules against Elliott, clears way for suspension

The lengthy court battle between the NFL and Cowboys running back Ezekiel Elliott turned in favor of the league Thursday, as the Fifth Circuit U.S. Court of Appeals in in New Orleans vacated Elliott's preliminary injunction, all but restoring his six-game suspension after the Cowboys' current bye week.

In the wake of today's ruling, the NFLPA is expected to re-file the case with the U.S. District Court for the Southern District of NY and could seek a temporary restraining order and preliminary injunction which would allow Elliott to keep playing, according to Gabe Feldman, director of the Tulane Sports Law Program (H/T NFL). The NFL has requested for a stay of the injunction that is allowing Elliott to play.

Elliott is expected to file an appeal. They next play October 22 at San Francisco.

A three-judge panel heard arguments on the case on October 2.

The case will essentially start all over again, but will now move from Texas to NY, where Elliott has 10 days to refile his motion to fight the suspension.

Elliott was never charged by OH authorities.

Elliott, the league's leading rusher last season as a rookie, has totaled 393 rushing yards in five games this season.
