Scott does not deny being contacted by the nursing home but said at no point did the home indicate the situation had become risky, criticizing the facility for not calling 911 to receive help quickly. According to the Miami Herald, the state categorized the voicemails as "transitory messages", which means they had limited long term value and Scott did not violate any laws by deleting them.

Natasha Anderson, a vice president with The Rehabilitation Center at Hollywood Hills, says she called the governor's cellphone to say the nursing home needed "immediate assistance" in restoring the power to their air conditioning system.

"The voicemails were not retained because the information from each voicemail was collected by the Governor's staff and given to the proper agency for handling", the response read.

CBS4 Miami requested copies of the voicemails left on a special line for health care administrators but was unable to determine what, exactly, the voicemails said since they were deleted by the governor's staff. On the morning of September 13, several residents died, and most others were evacuated or rushed to the hospital. "Every call was returned", Lauren Schenone, a spokeswoman for Scott, said in a statement on Sunday, according to the Miami Herald.

"None of this changes the fact that this facility chose not to call 911 or evacuate their patients to the hospital across the street to save lives", the spokeswoman noted, per WMAQ-TV.

Barbara Petersen of the First Amendment Foundation said the voicemails could be a valuable public record. "Why not just keep them?"

A second call came an hour later - but by the third call for help, the facility raised eyebrows that the situation may become deadlier and deadlier as temperatures increased and the nursing home was left without adequate air conditioning.

The daughter of a man who died at a Hollywood nursing home after Hurricane Irma has filed a lawsuit against the Rehabilitation Center at Hollywood Hills.

The next day, September 12, callers from the Rehabilitation Center left two voice mail messages on Scott's cell phone that were retrieved at 10:25 a.m.

The Department of Health said the nursing home was told that if they had anyone in distress they should call 911 for help.

According to reports, at least four messages from the Rehabilitation Center were received by the governor's phone and deleted.

An AHCA official returned one call to nursing home administrator Jorge Carballo at 4:17 p.m. September 12, the governor's office said. According to the governor's office timeline, both Carballo and Anderson said the nursing home's "chiller" wasn't working but that spot coolers and fans were in place.

On September 11, between 3am and 6am, five patients at the nursing home died.
